Develop policy and promote changes for regulatory framework on the integration of investigative judges as common law judges, and monitoring the process of evaluation of the current investigative judges

 

Objectives
  • Evaluation of the new legislative regulations on evaluation and integration of the current investigative judges as common law judges;
  • Promote the improvement of the regulatory framework on evaluation and integration of the current investigative judges as common law judges;
  • Contributing to increasing the quality and transparency of the assessment of the current investigative judges.
Activities
  • Develop a policy document on the evaluation and integration of the current investigative judges as common law judges;
  • Develop and promote proposals to improve the regulatory framework of the procedure and conditions for the reintegration of the investigative judges as common law judges.
  • Develop, publish and disseminate a monitoring report on the activity of the National Institute of Justice, of the Judges Performance Evaluation Board and Superior Council of Magistracy in training, evaluation and reconfirmation of the investigative judges as common law judges.
Results
  • Policy paper ”Reforming the Investigating Judge Institution: Challenges, Risks and Solutions” (11 December 2013);
  • Draft law and Information note (only in Romanian) to improve the legal framework on the procedures and conditions for the reintegration of the investigative judges as common law judges, drafted in collaboration with Ministry of Justice;
  • Policy paper ”Reallocation of the investigating judges: recommendations for each court” (only in Romanian), (4 September 2014);
  • Information on the activity of 19 investigating judges who have asked to be reconfirmed in the position of common law judges was submitted to the Judges Performance Evaluation Board;
  • Report ”Reforming the institution of the investigating judges in the Republic of Moldova” (January 2015).
