La aceast\u0103 concluzie au ajuns autorii analizei <a href=\"http:\/\/old2.old.crjm.org\/wp-content\/uploads\/2016\/02\/Document_Analitic-Interceptari_WEB_Logo_FOSI.pdf\">\u201e<b><span style=\"text-decoration: underline;\">Interceptarea convorbirilor telefonice \u00een Republica Moldova: progres sau regres<\/span><\/b><span style=\"text-decoration: underline;\">?<strong><em>(actualizat 2016.02.29)<\/em><\/strong><\/span><\/a>, elaborat de Centrul de Resurse Juridice din Moldova.<\/p>\n<p style=\"text-align: justify;\">Subiectul intercept\u0103rilor convorbirilor \u00een Republica Moldova a fost abordat dup\u0103 pronun\u021barea de c\u0103tre Curtea European\u0103 a Drepturilor Omului (CtEDO), \u00een septembrie 2009, a hot\u0103r\u00e2rii <i>Iordachi \u0219i Al\u021bii c. Moldovei<\/i>. \u00cen aceast\u0103 hot\u0103r\u00e2re CtEDO constat\u0103 c\u0103 legisla\u021bia cu privire la interceptarea convorbirilor nu con\u021binea garan\u021bii suficiente \u00eempotriva abuzului, iar num\u0103rul de autoriz\u0103ri ale intercept\u0103rilor convorbirilor telefonice era foarte \u00eenalt.<\/p>\n<p style=\"text-align: justify;\">Potrivit analizei, \u00een pofida modific\u0103rii, \u00een 2012, a legisla\u021biei privind intercept\u0103rile, num\u0103rul de demersuri din partea procurorilor de autorizare a intercept\u0103rilor a crescut alarmant \u00een ultimii ani, ajung\u00e2nd la 9,962 \u00een 2015, \u00een compara\u021bie cu 2,915 \u00een 2013. \u00cen acela\u0219i timp, rata autoriz\u0103rilor acordate de judec\u0103torii de instruc\u021bie a r\u0103mas la fel de \u00eenalt\u0103 \u2013 circa 98% anual.<\/p>\n<p style=\"text-align: justify;\">De\u0219i legisla\u021bia a fost \u00eembun\u0103t\u0103\u021bit\u0103, aceasta continu\u0103 s\u0103 aib\u0103 lacune, \u0219i anume nu oblig\u0103 judec\u0103torul de instruc\u021bie s\u0103 informeze persoana c\u0103 convorbirile sale au fost interceptate, atunci c\u00e2nd constat\u0103 ilegalitatea intercept\u0103rii \u0219i nu men\u021bioneaz\u0103 circumstan\u021bele \u00een care poate fi am\u00e2nat\u0103 informarea persoanei. Astfel, persoanele interceptate nu pot reac\u021biona eficient la ingerin\u021bele \u00een via\u021ba lor privat\u0103. De asemenea, legisla\u021bia permite procurorilor s\u0103 anexeze la dosarul penal doar rezultatele intercept\u0103rii pe care le consider\u0103 importante pentru cauza penal\u0103, iar partea ap\u0103r\u0103rii nu are acces la restul \u00eenregistr\u0103rilor care ar putea con\u021bine informa\u021bii importante pentru ea. Acest lucru las\u0103 spa\u021biu pentru abuz \u0219i poate reduce posibilit\u0103\u021bile de ap\u0103rare.<\/p>\n<p style=\"text-align: justify;\">Autorii analizei eviden\u021biaz\u0103 \u0219i alte caren\u021be ale practicii de interceptare, precum: lipsa informa\u021biilor cu privire la num\u0103rul de \u00eenregistr\u0103ri p\u0103strate \u0219i distruse de c\u0103tre procurori, care sunt confiden\u021biale, lipsa de spa\u021bii securizate \u00een unele judec\u0103torii \u00een care sunt p\u0103strate originalele intercept\u0103rilor. Totodat\u0103, controlul parlamentar al intercept\u0103rii convorbirilor nu este transparent.
