Acest termen poate fi prelungit cu cel mult 15 zile pentru clarificarea aspectelor importante ce \u021bin de candida\u021bii propu\u0219i. De la prima propunere a CSM a trecut mai mult de opt luni, iar de la urm\u0103toarele &#8211; mai mult de patru luni. \u00cen pofida dep\u0103\u0219irii termenelor legale, numirile la CSJ nu au fost incluse pe agenda plenului Parlamentului. Parlamentul poate refuza numirea judec\u0103torilor CSJ doar \u00een cazul depist\u0103rii unor probe incontestabile de incompatibilitate a candida\u021bilor, de \u00eenc\u0103lcare a legisla\u021biei sau a procedurilor legale de selectare \u0219i promovare a lor.<\/p>\n<p style=\"text-align: justify;\">P\u00e2n\u0103 la demararea procesului de vot pentru numirea \u00een func\u021bie a judec\u0103torilor, la CSJ r\u0103m\u00e2n a fi <a href=\"https:\/\/csm.md\/files\/Lista_judecatorilor\/2017\/Judecatori2018.pdf\">vacante 11 func\u021bii de judec\u0103tor<\/a><a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a>. Cu num\u0103rul actual de judec\u0103tori \u00een func\u021bie, \u021bin\u00e2nd cont \u0219i de alte circumstan\u021be precum deta\u0219area judec\u0103torilor CSJ, suspendarea din func\u021bie sau concediile de odihn\u0103 \u0219i cele medicale ale judec\u0103torilor, exist\u0103 riscul ca activitatea CSJ \u00een anumite perioade de timp s\u0103 fie blocat\u0103. \u00cen prezent \u0219edin\u021bele Plenului CSJ nu pot fi desf\u0103\u0219urate, deoarece la CSJ activeaz\u0103 efectiv mai pu\u021bin de dou\u0103 treimi (22 de judec\u0103tori) din num\u0103rul total al judec\u0103torilor CSJ.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a>\u00a0<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/rm.coe.int\/ccje-magna-carta-roumain\/168063e433\">Standardele europene privind independen\u021ba judec\u0103torilor<\/a> solicit\u0103 statelor s\u0103 asigure resursele umane, materiale \u0219i financiare necesare pentru buna func\u021bionare a justi\u021biei.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> Acestea mai prev\u0103d c\u0103 toate deciziile privind numirea \u0219i cariera profesional\u0103 a judec\u0103torilor s\u0103 se bazeze pe merit, \u00een baza unor criterii obiective \u0219i \u00een modul prev\u0103zut de lege.<\/p>\n<p style=\"text-align: justify;\"><strong>Organiza\u021biile semnatare solicit\u0103 Parlamentului Republicii Moldova s\u0103 demareze c\u00e2t de cur\u00e2nd posibil procedura de discutare a propunerilor CSM privind numirea judec\u0103torilor \u0219i vicepre\u0219edin\u021bilor CSJ. De asemenea, \u00eendemn\u0103m Parlamentul s\u0103 studieze cu cea mai marea aten\u021bie informa\u021biile publice ap\u0103rute despre judec\u0103torii propu\u0219i de c\u0103tre CSM.
