{"id":21330,"date":"2020-07-10T14:15:28","date_gmt":"2020-07-10T11:15:28","guid":{"rendered":"https:\/\/crjm.org\/?p=21330"},"modified":"2020-07-10T17:27:09","modified_gmt":"2020-07-10T14:27:09","slug":"mecanismul-de-raspundere-disciplinara-a-judecatorilor-trebuie-sa-devina-mai-simplu-si-mai-eficient","status":"publish","type":"post","link":"https:\/\/old.crjm.org\/ru\/mecanismul-de-raspundere-disciplinara-a-judecatorilor-trebuie-sa-devina-mai-simplu-si-mai-eficient\/","title":{"rendered":"Mecanismul de r\u0103spundere disciplinar\u0103 a judec\u0103torilor trebuie s\u0103 devin\u0103 mai simplu \u0219i mai eficient"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Mecanismul de r\u0103spundere disciplinar\u0103 a judec\u0103torilor<\/strong><strong> din Moldova este extrem de complex, ceea ce favorizeaz\u0103 ne\u00eencrederea \u00een proceduri at\u00e2t din partea justi\u021biabililor \u0219i a opiniei publice, c\u00e2t \u0219i din partea judec\u0103torilor. <\/strong><strong>\u00cen ultimii cinci ani de zile, la Consiliul Superior al Magistraturii (CSM) au fost depuse peste 7,500 de sesiz\u0103ri cu privire la ac\u021biunile judec\u0103torilor, \u00een baza c\u0103rora \u00een fa\u021ba Colegiului disciplinar au ajuns 250 de judec\u0103tori \u0219i au fost aplicate 49 de sanc\u021biuni. Pentru fiecare cauz\u0103, care parcurge toate etapele unei proceduri disciplinare, sunt implicate nu mai pu\u021bin de cinci institu\u021bii \u0219i alocate \u00eentre 30 \u0219i 38 de persoane, durata fiec\u0103rui caz fiind estimat\u0103 la circa 400 de zile. Astfel, mecanismul<\/strong> <strong>trebuie simplificat \u0219i eficientizat pentru a responsabiliza judec\u0103torii, f\u0103r\u0103 a afecta, desigur, independen\u021ba lor. <\/strong>Acestea sunt concluziile de baz\u0103 ale documentului analitic <a href=\"https:\/\/old2.old.crjm.org\/wp-content\/uploads\/2020\/07\/Raspunderea-disciplinara-a-judecatorilor-in-Republica-Moldova-interactiv.pdf\">\u201eR\u0103spunderea disciplinar\u0103 a judec\u0103torilor \u00een Republica Moldova. Evaluarea legisla\u021biei \u015fi a practicilor\u201d,<\/a> elaborat de Dr. Cristi DANILE\u021a, judec\u0103tor la Tribunalul Cluj din Rom\u00e2nia. Documentul analitic a fost lansat la 10 iulie 2020 la Chi\u0219in\u0103u.<\/p>\n<p style=\"text-align: justify;\">\u00cen opinia autorului, disfunc\u021bionalit\u0103\u021bile sistemului disciplinar \u021bin nu doar de modul de definire a abaterilor disciplinare, respectiv de procedura de tragere la r\u0103spundere disciplinar\u0103 a magistra\u021bilor, ci \u0219i de aspecte care privesc administrarea justi\u021biei \u0219i independen\u021ba judec\u0103torilor.<\/p>\n<p style=\"text-align: justify;\"><strong>Judec\u0103torii nu ar trebui sanc\u021biona\u021bi disciplinar nici pentru performan\u021be profesionale slabe, nici pentru \u00eenc\u0103lc\u0103ri de natur\u0103 etic\u0103. Abaterile disciplinare trebuie s\u0103 fie strict legate de activitatea desf\u0103\u0219urat\u0103 ca judec\u0103tor.<\/strong> \u00cen paralel cu consolidarea mecanismului disciplinar, trebuie f\u0103cute eforturi pentru optimizarea activit\u0103\u021bii judec\u0103torilor \u2013 asigurarea unui num\u0103r adecvat de dosare \u0219i a unui num\u0103r de judec\u0103tori \u0219i aparat tehnic suficient. Totodat\u0103, judec\u0103torii trebuie ap\u0103ra\u021bi de presiunile din interiorul sistemului (\u00een special din partea conduc\u0103torilor instan\u021belor), dar \u0219i din afar\u0103 (procurori \u0219i politicieni). Exist\u0103 declara\u021bii \u00eengrijor\u0103toare despre faptul c\u0103 judec\u0103torii care au adoptat solu\u021bii contrar a\u0219tept\u0103rilor sau au \u00eencercat s\u0103-\u0219i expun\u0103 opozi\u021bia fa\u021b\u0103 de asemenea influen\u021be, s-au ales imediat cu diferite proceduri disciplinare sau de alt\u0103 natur\u0103, calificative slabe sau au fost nevoi\u021bi s\u0103 plece din sistem.<\/p>\n<p style=\"text-align: justify;\">Legea privind r\u0103spunderea disciplinar\u0103 a judec\u0103torilor (\u00een vigoare din 2015) \u0219i noul Cod administrativ (\u00een vigoare din 2019) au \u00eengreunat activitatea de verificare \u015fi cercetare a judec\u0103torilor \u015fi au aglomerat organismele implicate \u00een procedura disciplinar\u0103. De exemplu, pe parcursul anului 2019, pentru doar 13 sanc\u021biuni disciplinare au fost alocate c\u00e2te 30 &#8211; 38 de persoane, din care cel pu\u021bin 16 au fost judec\u0103tori. Acest mecanism implic\u0103 prea multe institu\u021bii: Inspec\u021bia judiciar\u0103, Completul de admisibilitate, Colegiul disciplinar, CSM, curtea de apel \u0219i Curtea Suprem\u0103 de Justi\u021bie, ceea face mai anevoioas\u0103 procedura disciplinar\u0103. <strong>Pentru a eficientiza procesul, autorul recomand\u0103 reducerea timpului acordat acestuia \u0219i a resurselor umane implicate.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Inspec\u021bia judiciar\u0103 \u0219i Colegiul disciplinar ar trebui s\u0103 devin\u0103 \u00een practic\u0103 institu\u021bii autonome de CSM.<\/strong> Criteriile de selec\u021bia a judec\u0103torilor-inspectori trebuie modificate, num\u0103rul lor trebuie majorat, iar Inspec\u021bia judiciar\u0103 s\u0103 beneficieze de un aparat propriu. Atribu\u021biile \u00een materie disciplinar\u0103 ale Colegiului disciplinar \u0219i CSM se suprapun, astfel c\u0103 se recomand\u0103 delegarea complet\u0103 a acestora de c\u0103tre CSM Colegiului disciplinar. De asemenea, se recomand\u0103 \u00eembun\u0103t\u0103\u021birea calit\u0103\u021bii motiv\u0103rilor hot\u0103r\u00e2rilor adoptate.<\/p>\n<p style=\"text-align: justify;\">Constat\u0103rile \u0219i recomand\u0103rile ce \u021bin de eficientizarea activit\u0103\u021bii \u00een materie disciplinar\u0103 pot fi g\u0103site \u00een documentul <a href=\"https:\/\/old2.old.crjm.org\/wp-content\/uploads\/2020\/07\/Raspunderea-disciplinara-a-judecatorilor-in-Republica-Moldova-interactiv.pdf\">analitic \u201eR\u0103spunderea disciplinar\u0103 a judec\u0103torilor \u00een Republica Moldova.
