Aceasta este principala concluzie a Documentului de politici publice: \u201e<a href=\"http:\/\/old2.old.crjm.org\/wp-content\/uploads\/2017\/07\/CRJM-Selectia-si-cariera-jud-2017.pdf\">Selec\u021bia \u0219i promovarea judec\u0103torilor \u00een Republica Moldova \u2013 provoc\u0103ri \u0219i necesit\u0103\u021bi<\/a>\u201d, elaborat de Centrul de Resurse Juridice din Moldova (CRJM) \u00een urma analizei procesului de selec\u021bie \u0219i promovare a judec\u0103torilor \u00een perioada ianuarie 2013 \u2013 mai 2017.<\/p>\n<p style=\"text-align: justify;\">Printre problemele constatate de autorii analizei este faptul c\u0103 Consiliul Superior al Magistraturii (CSM) nume\u0219te \u0219i promoveaz\u0103 \u00een func\u021bii judec\u0103torii ignor\u00e2nd punctajul oferit de Colegiul pentru selec\u021bia \u0219i cariera judec\u0103torilor, iar \u00een hot\u0103r\u00e2rile sale nu motiveaz\u0103 deciziile luate. Totodat\u0103, concursurile de numire \u0219i promovare a judec\u0103torilor sunt organizate continuu, f\u0103r\u0103 vreo previzibilitate \u0219i metodologie, iar un num\u0103r mare de concursuri sunt declarate de CSM e\u0219uate deoarece candida\u021bii \u201enu au \u00eentrunit num\u0103rul necesar de voturi\u201d ale membrilor CSM, f\u0103r\u0103 a fi prezentate argumente pentru neacordarea voturilor. Ulterior, \u00een cadrul altor concursuri, candida\u021bi \u201ee\u0219ua\u021bi\u201d deja \u00eentrunesc num\u0103rul necesar de voturi \u0219i sunt numi\u021bi \u00een func\u021bii.<\/p>\n<p style=\"text-align: justify;\">Analiza efectuat\u0103 arat\u0103 c\u0103, \u00een perioada 2013 &#8211; mai 2017, dintre cei 115 judec\u0103tori selecta\u021bi \u00een urma concursurilor cu participarea a cel pu\u021bin 2 candida\u021bi, peste 72% din candida\u021bii la func\u021bia de judec\u0103tor \u00een judec\u0103torii, 42% dintre cei propu\u0219i pentru promovare la Curtea Suprem\u0103 de Justi\u021bie (CSJ) \u0219i 39% dintre cei propu\u0219i pentru promovare la cur\u021bile de apel au punctaje mai mici dec\u00e2t contracandida\u021bii lor.<\/p>\n<p style=\"text-align: justify;\">Autorii analizei au stabilit c\u0103 este mare num\u0103rul numirilor \u00een func\u021bie \u00een urma concursurilor cu participarea unui singur candidat, ceea ce nu este un concurs veritabil \u0219i nu permite selectarea celui mai bun candidat. Spre exemplu, \u00een perioada de referin\u021b\u0103 23% din candida\u021bii propu\u0219i pentru numirea \u00een judec\u0103torii, 65% din cei propu\u0219i pentru numirea la func\u021bii de conducere \u00een judec\u0103torii, 83% pentru numirea la func\u021bii de conducere \u00een cur\u021bile de apel \u0219i 100% pentru cei propu\u0219i la func\u021bii de conducere \u00een cadrul CSJ sunt candida\u021bi care au fost numi\u021bi \u00een urma concursurilor cu un singur candidat. \u00cen acela\u0219i timp, 10-14% din toate concursurile anun\u021bate (21% pentru promovarea la CSJ) sunt declarate de CSM ca fiind e\u0219uate, din motiv c\u0103 un candidat sau candida\u021bii participan\u021bi nu au \u00eentrunit num\u0103rul necesar de voturi din partea membrilor CSM.<\/p>\n<p style=\"text-align: justify;\">A fost observat\u0103 o lips\u0103 de interes a judec\u0103torilor de a participa la concursuri pentru func\u021bii de conducere \u00een instan\u021be. Astfel, multe concursuri anun\u021bate de CSM pentru promovarea la cur\u021bile de apel sau \u00een func\u021bii de conducere la cur\u021bile de apel (63%) \u0219i CSJ (38%) au avut loc cu participarea unui singur candidat, sau nu au avut loc deoarece nu au existat candida\u021bi sau ace\u0219tia s-au retras p\u00e2n\u0103 la votare, determin\u00e2nd CSM-ul s\u0103 anun\u021be concursuri repetate. Declararea de c\u0103tre CSM a unui num\u0103r mare de concursuri ca fiind e\u0219uate, de r\u00e2nd cu nemotivarea hot\u0103r\u00e2rilor sale, ar putea fi printre cauzele care descurajeaz\u0103 judec\u0103torii s\u0103 participe la aceste concursuri.<\/p>\n<p style=\"text-align: justify;\">Autorii documentului consider\u0103 c\u0103 numirea \u0219i promovarea candida\u021bilor \u00een baz\u0103 de merit este o condi\u021bie esen\u021bial\u0103 pentru existen\u021ba unui sistem judiciar independent, responsabil \u0219i profesionist, iar transparen\u021ba procesului de numire \u0219i promovare este important\u0103 pentru asigurarea \u00eencrederii \u00een justi\u021biei at\u00e2t a judec\u0103torilor \u0219i altor profesioni\u0219ti care aspir\u0103 la func\u021bia de judec\u0103tor, c\u00e2t \u0219i a societ\u0103\u021bii.<\/p>\n<p style=\"text-align: justify;\">Autorii analizei recomand\u0103:<\/p>\n<ul>\n<li style=\"text-align: justify;\">\u00eembun\u0103t\u0103\u021birea sistemului de selec\u021bie \u0219i promovare a judec\u0103torilor prin utilizarea rezultatelor evalu\u0103rii Colegiului de Selec\u021bie la numirea \u0219i promovarea candida\u021bilor \u0219i prevederea \u00een legisla\u021bie a dreptului candida\u021bilor la func\u021bia de judec\u0103tor care au cel mai \u00eenalt punctaj de a-\u0219i alege instan\u021ba \u00een care s\u0103 activeze;<\/li>\n<li style=\"text-align: justify;\">organizarea concursurilor pentru toate func\u021biile vacante \u00een sistemul judec\u0103toresc o dat\u0103 sau de dou\u0103 ori pe an, ceea ce va permite candida\u021bilor s\u0103-\u0219i planifice din timp cariera \u0219i va da posibilitate CSM-ului s\u0103-\u0219i planifice activitatea \u0219i va oferi suficient timp pentru motivarea hot\u0103r\u00e2rilor;<\/li>\n<li style=\"text-align: justify;\">motivarea hot\u0103r\u00e2rilor CSM cu privire la cariera judec\u0103torilor, \u00een cazul \u00een care CSM ignor\u0103 punctajul oferit de Colegiul de Selec\u021bie sau concursul este declarat e\u0219uat.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">De asemenea, se recomand\u0103 reevaluarea urgent\u0103 a criteriilor de selec\u021bie, promovare \u0219i transfer a judec\u0103torilor, care au o serie de caren\u021be eviden\u021biate anterior at\u00e2t de <a href=\"http:\/\/old2.old.crjm.org\/wp-content\/uploads\/2015\/01\/CRJM-DPP-Selectie-si-cariera.pdf\">CRJM<\/a>, <a href=\"http:\/\/www.capc.md\/files\/Raport%20de%20monitorizare%20CAPC_30.05.17.pdf\">c\u00e2t \u0219i de alte organiza\u021bii<\/a>.
