Aceast\u0103 constatare a fost formulat\u0103 \u00een urma analizei legisla\u021biei Republicii Moldova \u0219i compatibilit\u0103\u021bii acesteia cu standardele europene \u00een domeniul egalit\u0103\u021bii \u0219i nediscrimin\u0103rii, efectuat\u0103 de Centrul de Resurse Juridice din Moldova (CRJM) \u0219i Centrul Euroregional pentru Ini\u021biative Publice (ECPI).<\/p>\n<p style=\"text-align: justify;\">Principalele caren\u021be ale legisla\u021biei \u021bin de statutul incert \u0219i competen\u021bele limitate ale Consiliului pentru Prevenirea \u0219i Eliminarea Discrimin\u0103rii \u0219i Asigurarea Egalit\u0103\u021bii (CPPEDAE). CPPEDAE nu poate aplica sanc\u021biuni de sine st\u0103t\u0103tor atunci c\u00e2nd constat\u0103 o fapt\u0103 de discriminare, nu are competen\u021ba de a sesiza direct Curtea Constitu\u021bional\u0103, iar recomand\u0103rile acestuia r\u0103m\u00e2n, \u00een multe cazuri, doar recomand\u0103ri. Legisla\u021bia na\u021bional\u0103, de asemenea, nu cuprinde norme de nediscriminare \u00een unele acte normative care reglementeaz\u0103 domenii specifice, de o importan\u021b\u0103 major\u0103, cum ar fi: achizi\u021biile publice, prestarea serviciilor medicale \u0219i, \u00een general, activitatea func\u021bionarilor \u0219i demnitarilor publici.<\/p>\n<p style=\"text-align: justify;\">Analiza efectuat\u0103 a indicat c\u0103 sunt necesare eforturi \u0219i \u00een domeniul aplic\u0103rii standardelor nediscrimin\u0103rii \u00een practica de zi cu zi. CPPEDAE, spre exemplu, a reflectat \u00een jurispruden\u021ba sa prejudec\u0103\u021bi majore \u00een atitudinea avoca\u021bilor care acord\u0103 asisten\u021b\u0103 juridic\u0103 garantat\u0103 de stat fa\u021b\u0103 de modul de reprezentare a persoanelor cu dizabilit\u0103\u021bi mintale. De asemenea, practica CPPEDAE a indicat o anumit\u0103 incoeren\u021b\u0103 \u00een abordarea instan\u021belor de judecat\u0103 fa\u021b\u0103 de cererile depuse \u00een limba rus\u0103. Problema pare s\u0103 \u021bin\u0103 de responsabilitatea sistemului justi\u021biei, dar adev\u0103rata cauz\u0103 a incertitudinii se reg\u0103se\u0219te \u00een legisla\u021bia extrem de confuz\u0103 \u00een acest domeniu, o chestiune care urmeaz\u0103 a fi solu\u021bionat\u0103 de legiuitor.<\/p>\n<p style=\"text-align: justify;\">Autorii analizei consider\u0103 c\u0103 \u0219i practica instan\u021belor de judecat\u0103 \u00een domeniul nediscrimin\u0103rii trebuie \u00eembun\u0103t\u0103\u021bit\u0103. Atunci c\u00e2nd instan\u021bele de judecat\u0103 sunt sesizate direct cu privire la o fapt\u0103 de discriminare, acestea se confrunt\u0103 cu probleme la stabilirea corect\u0103 a sarcinii proba\u021biunii, specifice \u00een cauzele de discriminare. Contestarea deciziilor CPPEDAE \u00een instan\u021bele de judecat\u0103 \u00een procedur\u0103 de contencios administrativ nu permite instan\u021belor s\u0103 analizeze \u00een esen\u021b\u0103 dac\u0103 a avut sau nu loc fapta de discriminare. Procesele-verbale emise de CPPEDAE sunt anulate de instan\u021bele de judecat\u0103 pe motive formale.
