Analiza este disponibil\u0103 \u00een limbile <a href=\"http:\/\/old2.old.crjm.org\/wp-content\/uploads\/2015\/07\/CRJM-Studiu-Compat-legislatie-MD-EU-2015-07.pdf\">rom\u00e2n\u0103<\/a>, <a href=\"http:\/\/old2.old.crjm.org\/wp-content\/uploads\/2015\/07\/LRCM-Compatib-MD-EU-nondiscrim-legisl-2015-07.pdf\">englez\u0103<\/a> \u0219i <a href=\"http:\/\/old2.old.crjm.org\/wp-content\/uploads\/2015\/12\/CRJM-Compatib-legi-MD-EU-discrim-ru.pdf\">rus\u0103<\/a>.<\/p>\n<p style=\"text-align: justify;\"><a href=\"http:\/\/old2.old.crjm.org\/wp-content\/uploads\/2015\/07\/CRJM-Studiu-Compat-legislatie-MD-EU-2015-07.pdf\">Analiza compatibilit\u0103\u021bii legisla\u021biei din Republica Moldova cu standardele europene \u00een domeniul egalit\u0103\u021bii \u0219i nediscrimin\u0103rii<\/a> a examinat, \u00een special, mecanismul na\u021bional de protec\u021bie \u00eempotriva discrimin\u0103rii creat prin Legea nr. 121 cu privire la asigurarea egalit\u0103\u021bii din 25 mai 2012 \u0219i anume mandatul \u0219i practica Consiliului pentru Prevenirea \u0219i Eliminarea Discrimin\u0103rii \u0219i Asigurarea Egalit\u0103\u021bii (CPPEDAE) \u0219i a instan\u021belor de judecat\u0103. Astfel, una dintre constat\u0103rile-cheie ale studiului este c\u0103 Legea nr. 121, \u00een mare parte conform\u0103 standardelor europene, are o lacun\u0103 major\u0103 ce \u021bine de competen\u021bele CPPEDAE. Legea acord\u0103 CPPEDAE competen\u021be privind legisla\u021bia \u0219i politicile, prevenirea discrimin\u0103rii \u0219i examinarea pl\u00e2ngerilor individuale. \u00cen acela\u0219i timp, legea nu-i acord\u0103 dou\u0103 competen\u021be importante, care reduc semnificativ rolul CPPEDAE: cea de a aplica sanc\u021biuni pentru faptele de discriminare \u0219i de a sesiza Curtea Constitu\u021bional\u0103 \u00een cazul \u00een care consider\u0103 c\u0103 unele prevederi legislative sunt discriminatorii.<\/p>\n<p style=\"text-align: justify;\">Recomandarea-cheie a studiului const\u0103 \u00een revizuirea Legii nr. 121 \u0219i a cadrului normativ conex pentru a acorda CPPEDAE competen\u021be depline, \u0219i anume competen\u021ba de a aplica sanc\u021biuni pentru faptele de discriminare \u0219i dreptul de a sesiza Curtea Constitu\u021bional\u0103. Recomand\u0103rile formulate \u00een urma efectu\u0103rii analizei sunt adresate Guvernului, instan\u021belor de judecat\u0103, CPPEDAE, Biroului de Rela\u021bii Interetnice \u0219i Avocatului Poporului. Totodat\u0103, studiul va fi o resurs\u0103 util\u0103 pentru reprezentan\u021bii societ\u0103\u021bii civile \u0219i ai comunit\u0103\u021bii donatorilor, interesa\u021bi de promovarea egalit\u0103\u021bii \u0219i nediscrimin\u0103rii \u00een Republica Moldova.<\/p>\n<p style=\"text-align: justify;\">Documentul a fost elaborat de CRJM \u00een parteneriat cu ECPI, \u00een cadrul proiectului \u201ePromovarea egalit\u0103\u021bii \u2013 consolidarea agen\u021bilor schimb\u0103rii\u201d, finan\u021bat de Uniunea European\u0103.<\/p>\n<p style=\"text-align: justify;\">\u00cen cadrul proiectului au fost implementate dou\u0103 programe de formare de formatori \u00een domeniul nediscrimin\u0103rii, unul pentru cadre didactice \u0219i altul pentru asisten\u021bi sociali.
