CRJM a analizat eficien\u021ba Consiliului"},"content":{"rendered":"<p><strong>Centrul de Resurse Juridice din Moldova a efectuat o analiz\u0103 a activit\u0103\u021bii Consiliului de Integritate (CI) \u00een primii 5 ani de la creare. Cercetarea eviden\u021biaz\u0103 mai multe disensiuni \u00eentre membrii Consiliului \u0219i conducerea Autorit\u0103\u021bii Na\u021bionale de Integritate (ANI) \u0219i constat\u0103 exercitarea incomplet\u0103 a atribu\u021biilor prev\u0103zute de lege. De asemenea, raportul vine \u0219i cu o serie de recomand\u0103ri menite s\u0103 \u00eembun\u0103t\u0103\u021beasc\u0103 activitatea Consiliului.<\/strong><\/p>\n<p>Printre concluziile raportului reg\u0103sim:<\/p>\n<blockquote>\n<p><strong>Primii 5 ani de activitate a Consiliului de Integritate al ANI au fost marca\u021bi de disensiuni \u0219i lips\u0103 de cooperare;\u00a0<\/strong><\/p>\n<p><strong>Doar 26 din cei 46 de inspectori de integritate au fost recruta\u021bi \u00een primii ani de activitate ai Consiliului.<\/strong><\/p>\n<\/blockquote>\n<p>Chiar dac\u0103 membrii Consiliului de Integritate sunt numi\u021bi pe un termen de 5 ani, \u00een perioada analizat\u0103 (1 august 2016 \u2013 31 decembrie 2021), componen\u021ba Consiliului a fost modificat\u0103 frecvent, intervenind \u0219ase cereri de demisie. Mai mult, de la sf\u00e2r\u0219itul lunii septembrie 2021, CI a devenit nefunc\u021bional, iar activitatea acestuia a fost suspendat\u0103.<\/p>\n<p>Printre cauzele acestei instabilit\u0103\u021bi se num\u0103r\u0103 schimb\u0103rile de ordin politic, lipsa de interes de a activa \u00een cadrul acestui organ, dar \u0219i nerespectarea termenelor de c\u0103tre autorit\u0103\u021bile responsabile de desemnarea membrilor \u00een cadrul Consiliului.<\/p>\n<p><strong>\u00cen perioada de monitorizare, Consiliul a ini\u021biat \u0219i a promovat mai multe documente necesare institu\u021bionaliz\u0103rii ANI. Totu\u0219i, procesul de selectare a conducerii ANI a fost tergiversat \u0219i a durat aproape un an, iar selectarea inspectorilor de integritate este \u0219i mai anevoioas\u0103 \u2013 doar 26 din cei 46 de inspectori au fost recruta\u021bi.<\/strong><\/p>\n<p>Consiliul nu a fost eficient \u00een promovarea unor \u00eembun\u0103t\u0103\u021biri \u00een domeniul integrit\u0103\u021bii, \u00een a reac\u021biona la ini\u021biativele legislative primejdioase pentru func\u021bionarea ANI \u0219i nici \u00een promovarea imaginii ANI. \u00cen acela\u0219i timp, Consiliul nu a dispus nicio verificare veridic\u0103 a averilor conducerii ANI \u0219i nici a inspectorilor de integritate, deoarece, \u00een practic\u0103, nu are acces la registrele de stat.<\/p>\n<p>Autorul cercet\u0103rii, consilierul juridic al CRJM, Daniel Goinic, remarc\u0103 faptul c\u0103 lipsa unui secretariat permanent al Consiliului de Integritate, de asemenea, a afectat substan\u021bial eficien\u021ba acestuia.<\/p>\n<blockquote>\n<p><em><strong>\u201eLa moment, o singur\u0103 persoan\u0103 activeaz\u0103 \u00een secretariatul Consiliului cu o norm\u0103 de munc\u0103 de 80%, care se ocup\u0103 de chestiuni administrative. Propunerea noastr\u0103 este ca, pe l\u00e2ng\u0103 aceast\u0103 persoan\u0103, s\u0103 mai fie \u00eencadrat cel pu\u021bin un jurist care s\u0103 faciliteze elaborarea actelor necesare activit\u0103\u021bii Consiliului\u201d,<\/strong><\/em>a declarat Daniel Goinic.<\/p>\n<\/blockquote>\n<p>La evenimentul de prezentare a raportului a participat \u0219i pre\u0219edinta ANI, Rodica Antoci, care a subscris sub mai multe probleme identificate \u00een raportul CRJM \u0219i a exprimat speran\u021ba ca noua structur\u0103 \u0219i componen\u021b\u0103 a Consiliulului, al\u0103turi de ANI, s\u0103 livreze mai multe rezultate pe care le a\u0219teapt\u0103 societatea.<\/p>\n<blockquote>\n<p><strong><em>\u201eVom depune maxim efort cu noii membri ai Consiliului de Integritate pentru ca recomand\u0103rile acestui studiu, dar \u0219i a partenerilor de dezvoltare s\u0103 fie aplicate \u0219i, \u00eentr-un termen restr\u00e2ns, s\u0103 dovedim c\u0103 suntem o institu\u021bie consolidat\u0103 \u0219i eficient\u0103 \u00een Republica Moldova\u201d<\/em><\/strong>, a declarat Rodica Antoci.<\/p>\n<\/blockquote>\n<p>Secretara de stat a Ministerului Justi\u021biei, Veronica Mihailov-Moraru, a subliniat importan\u021ba acestui studiu pentru institu\u021biile responsabile de verificarea integrit\u0103\u021bii \u00een Republica Moldova, men\u021bion\u00e2nd c\u0103 ultimele modific\u0103ri legislative creeaz\u0103 toate premizele ca problemele identificate s\u0103 fie dep\u0103\u0219ite c\u00e2t mai cur\u00e2nd.<\/p>\n<blockquote>\n<p><em><strong>\u201eEste inadmisibil ca problemele ce \u021bin de lipsa adopt\u0103rii Strategiei ANI, de cadrele lips\u0103 s\u0103 persiste\u201d<\/strong><\/em>, a declarat Veronica Mihailov-Moraru, ad\u0103ug\u00e2nd c\u0103, din partea Ministerului Justi\u021biei, sunt depuse toate efoturile pentru a asigura eficien\u021ba Consiliului \u0219i a ANI, implicit.<\/p>\n<\/blockquote>\n<p>Raportul <a href=\"https:\/\/old2.old.crjm.org\/wp-content\/uploads\/2022\/02\/wp-1645518477997.pdf\">\u201eActivitatea Consiliului de Integritate (1 august 2016 \u2013 31 decembrie 2021)\u201d<\/a> reprezint\u0103 o incursiune succint\u0103 \u00een istoricul organiz\u0103rii \u0219i func\u021bion\u0103rii Consiliului. Scopul nu este de a critica activitatea acestuia, dar mai degrab\u0103 de a clarifica aspectele care \u021bin de transparen\u021ba \u0219i eficien\u021ba Consiliului, care nu au reu\u0219it a fi puse \u00een func\u021biune pe deplin sau din care pot fi extrase \u201elec\u021bii\u201d pentru noii membri, care \u00ee\u0219i vor \u00eencepe activitatea \u00een cur\u00e2nd.<\/p>\n<p>La aceast\u0103 etap\u0103, proiectul cercet\u0103rii este propus spre consultare public\u0103.
