{"id":16882,"date":"2019-01-25T10:32:01","date_gmt":"2019-01-25T08:32:01","guid":{"rendered":"http:\/\/crjm.org\/?p=16882"},"modified":"2019-05-24T17:02:13","modified_gmt":"2019-05-24T14:02:13","slug":"moldova-este-din-nou-fruntasa-dupa-numarul-de-cereri-depuse-la-ctedo","status":"publish","type":"post","link":"https:\/\/old.crjm.org\/en\/moldova-este-din-nou-fruntasa-dupa-numarul-de-cereri-depuse-la-ctedo\/","title":{"rendered":"Moldova, again in the top 5 countries by the number of applications submitted to the ECtHR and relative to the population of the country"},"content":{"rendered":"<p style=\"text-align: justify;\">Centrul de Resurse Juridice din Moldova (CRJM) a analizat activitatea Cur\u021bii Europene a Drepturilor Omului (CtEDO) pentru anul 2018 pentru a stabili care este\u00a0situa\u021bia pe dosarele Republicii Moldova la CtEDO, inclusiv \u00een compara\u021bie cu alte state membre ale Conven\u021biei Europene pentru Drepturile Omului (CEDO).<\/p>\n<p style=\"text-align: justify;\">Analiza<a href=\"https:\/\/www.echr.coe.int\/Documents\/Annual_report_2018_ENG.pdf\"> raportului de activitate al CtEDO pentru anul 2018<\/a> relev\u0103 faptul c\u0103 \u00een anul 2018, CtEDO a \u00eenregistrat cu 32% mai pu\u021bine cereri dec\u00e2t \u00een anul 2017. Exper\u021bii CRJM consider\u0103 c\u0103 sc\u0103derea este determinat\u0103, \u00een principal, de descre\u0219terea popularit\u0103\u021bii CtEDO, dup\u0103 ce \u00een anii 2011-2018 CtEDO a respins f\u0103r\u0103 o motivare clar\u0103 circa 300,000 de cereri moldovene\u0219ti, iar acest lucru a avut un efect descurajant asupra avoca\u021bilor.<\/p>\n<p style=\"text-align: justify;\">\u00cens\u0103 \u00een pofida reducerii \u00eenregistrare \u00een 2018, num\u0103rul cererilor depuse la CtEDO \u00eempotriva Moldovei este foarte mare dac\u0103 \u00eel raport\u0103m la popula\u021bia \u021b\u0103rii, Moldova ocup\u00e2nd locul 5 din cele 47 de \u0163\u0103ri membre ale Consiliului Europei. \u00cen 2018, moldovenii s-au adresat la CtEDO de 2.5 ori mai des dec\u00e2t media european\u0103, rata \u00eenalt\u0103 a cererilor fiind explicat\u0103 prin lipsa \u00eembun\u0103t\u0103\u021birilor la capitolul respect\u0103rii drepturilor omului.<\/p>\n<p style=\"text-align: justify;\">La 31 decembrie 2018, 1,204 de cereri moldovene\u0219ti \u00eenc\u0103 a\u0219teptau s\u0103 fie examinate, 93% dintre acestea av\u00e2nd \u0219anse mari de succes. Acest num\u0103r este mult mai mare dec\u00e2t num\u0103rul total de cereri \u00een baz\u0103 c\u0103rora Moldova a fost condamnat\u0103 \u00een ultimii 21 de ani.<\/p>\n<p style=\"text-align: justify;\">P\u00e2n\u0103 la 31 decembrie 2018, CtEDO a pronun\u021bat 387 de hot\u0103r\u00e2ri \u00een cauzele moldovene\u0219ti, dintre care 33 \u00een anul 2018. La acest capitol, Moldova devanseaz\u0103 cu mult Germania, Spania sau Olanda, \u021b\u0103ri care au aderat la CEDO cu mult timp \u00eenaintea Moldovei \u015fi au o populatei cu mult mai mare dec\u00e2t cea a Moldovei. Doar \u00een 6 hot\u0103r\u00e2ri (18%) din cele pronun\u021bate \u00een 2018, CtEDO a constatat c\u0103 Republica Moldova nu a violat CEDO.
